(Reuters) - Affirmative action for minorities, human rights abuses and the constitutional authority for dogs to sniff out crime will top the U.S. Supreme Court's agenda when it returns to the bench on Monday. An even bigger issue, same-sex marriage, lurks on the horizon.
The new term marks the full court's first return to the public eye since June when Chief Justice John Roberts surprised many by joining four more liberal justices in a 5-4 decision that upheld nearly all of President Barack Obama's healthcare law.
The court will start with one of its most anticipated cases, Kiobel v. Royal Dutch Petroleum, and address for the second time the extent to which American judges are empowered to hear lawsuits over human rights atrocities abroad.
On October 10, it will hear perhaps the biggest case on the docket so far, Fisher v. University of Texas at Austin, and weigh whether using race in undergraduate admissions to increase diversity is still acceptable under the U.S. Constitution.
"When you look at Kiobel and Fisher, and the possibility the court will visit the issues of gay marriage and voting rights, it's already shaping up to be a momentous term," said Ted Shaw, a professor at Columbia Law School and former director-counsel of the NAACP Legal Defense Fund.
Some justices said over the summer break that the court would, as it normally does, move past the divisions that end a term, including this year over a tough Arizona immigration law.
Dissenting justices in that and the healthcare cases read parts of their opinions from the bench, signaling profound disagreement with the majorities.
The court often finds common ground, and last term it ruled unanimously nearly as often as not. But many closely watched cases still produce 5-4 ideological splits. The five more conservative justices were appointed by Republican presidents, and the four more liberal justices by Democratic presidents.
While Justice Anthony Kennedy is at the ideological center, Roberts' vote to uphold most of the Affordable Care Act was a forceful reminder of his capacity to put his own cast on the law. At age 57, he could do so for another quarter century.
"John Roberts enormously strengthened his administrative hand and legal influence in ruling as he did," said Douglas Kmiec, a constitutional law professor at Pepperdine University in Malibu, California. "Now both sides probably believe they need to work for his support, and that's an enviable position for the chief justice."
The court already has accepted close to 40 cases for the new term, filling roughly half of its usual docket.
RACE AS A FACTOR
In Kiobel, the court will again review the Alien Tort Statute, a long-obscure 1789 law that lawyers have used in the last three decades to challenge corporations' alleged aiding or acquiescing in foreign governments' abuse of their own people.
After hearing arguments in February, the court decided to hold a new hearing to address whether judges could hear such claims brought against anyone, not just corporations.
The case has drawn dozens of briefs from other interested parties. The Obama administration has argued that the law could be used, case-by-case, for claims of abuse that might interfere with U.S. foreign relations or respect for human rights.
In the affirmative action case, Texas' flagship university has for several years filled about three-quarters of its undergraduate class by granting automatic admission to students in the top 10 percent of their high-school classes.
While this "race-neutral" approach has boosted the number of black and Hispanic students because of the homogeneity of many high schools, Texas uses race as one factor to fill the rest of each class, with a goal of improving the educational experience.
This has been challenged, and changes in the Supreme Court's makeup may imperil the 2003 decision, Grutter v. Bollinger, that let universities take race into account to improve diversity.
Justice Sandra Day O'Connor, who in that case endorsed race-based admissions at the University of Michigan law school, retired in 2006 and was replaced by the more conservative Justice Samuel Alito.
In addition, Justice Elena Kagan, who was U.S. solicitor general before joining the court in 2010, has recused herself. This could make it hard for Texas to win more than four votes. A decision voiding the program would likely apply, under a different law, to private universities.
Also on the docket are two "dog sniff" cases from Florida that test the boundary of Fourth Amendment protection against illegal searches, and which the court will take up on October 31.
One, Florida v. Jardines, concerns whether a homeowner's privacy was violated when a trained narcotics dog named Franky was allowed to walk near a home, and appeared to correctly detect a marijuana odor from inside. Another, Florida v. Harris, concerns an "alert" given by another dog named Aldo while being led around a truck that contained methamphetamine ingredients.
SAME-SEX MARRIAGE
All of these cases could well be dwarfed in public attention should the Supreme Court review any or all of a half-dozen cases concerning same-sex marriages.
Several address the constitutionality of the Defense of Marriage Act, which requires the government to deny benefits such as Social Security payments to gay and lesbian couples. even if they live in states that allow same-sex marriage.
A federal appeals court in Boston said that requirement should not stand. Paul Clement, a former U.S. solicitor general who last term argued against the healthcare law, represents defenders of DOMA while his opponent in the healthcare case, Solicitor General Donald Verrilli, wants DOMA to be invalidated.
Also awaiting review is a lower-court decision striking down California's ban on same-sex marriage, known as Proposition 8.
The Supreme Court is expected to announce this fall whether it will accept any of these cases. Decisions would likely come by the end of June, before the court's usual summer recess.
Meanwhile, the court may also weigh the constitutionality of a provision of the 1965 Voting Rights Act that requires states with histories of discrimination to get U.S. Department of Justice permission before changing election procedures.
"We're seeing an increase in voting suppression," said Scot Powe, a professor at the University of Texas at Austin and former clerk for Justice William O. Douglas. "If they take a Voting Rights Act case, the betting money is that they will invalidate the preclearance provision. That's a big deal."

Budget deficits should be controlled by the local governments. In addition, further spats with creditors have to be avoided and so there is need for the deficit cuts by the municipalities. When the local government takes the regular steps in order to survive, the municipal bond investors and their invested amount of the tune of $3.7-trillion will be very much affected. The municipal bond defaulters are the cities in California; viz. Vallejo, Mammoth Lakes, Stockton, and San Bernardino. Compton is the next most likely town to follow suit; the reason being that all theses towns are facing the problem of big budget deficits.
During days of healthy financial markets, there is substantial consumer spending. Like for example if one considers Bell, which is a city outside of Los Angles; it is said that in the year 2010, it paid an amount of $800,000 a year to the city managers. On account of being burdened with enormous budget deficits, cities filed for bankruptcy. The chief resources of revenue of the municipal governments are the property taxes, but when such sources are blocked, cities need to search for different means to make revenue for the payment of dues or just show their helplessness in being able to pay the municipal bond investors. Though the plan looks clever enough, i.e. defaulting on the municipal bonds and starting again, it simply does not work. Examples of cities that have already defaulted as mentioned above are Stockton, California and Jefferson County in Alabama.
Stockton, California has pensions to the tune of $26.0 million each year, which it must pay; as a result of which its municipal bond insurers may be badly hit by an amount above $100 million. In 2011, Jefferson County; not being successful in planning its finances to control the budget deficit, had filed for chapter-nine bankruptcy (which gives protection from creditors to municipalities comprising cities, counties, townships and school districts that are financially in doldrums by working towards a plan between them to resolve the outstanding debt). The municipal bond insurers now remain restless that they may stand to lose an amount near about $709 million.
As per reports from Bloomberg, September 10, 2012, Wenatchee, Washington, Scranton, Pennsylvania, and Moberly, Missouri have also defaulted on their municipal bonds payments as they did not have the requisite available cash.
Thus it can be clearly seen that there will be bound to be an increase in the number of municipal bankruptcies, which will in turn, hit the municipal bond investor to a large extent. It would be advisable for bond investors to exercise caution while purchasing bonds and not get hooked by endorsements of exemption from taxes.

Scientists used to believe that a sleeping brain was taking a break. But it turns out it can be taught a thing or two, scientists reported in a scientific journal published in August.

Food ? Big brands says their mid-calorie goodies cut down on what?s bad for you.
New York ? Nonfat cheese that tastes like plastic. Low-calorie soda that leaves a bitter aftertaste. Sugar-free brownies that crumble like Styrofoam.
Dieters have learned an important lesson. When you take the fat and calories out of your favorite treats, you sometimes have to say goodbye to the taste, too.
But snack brands such as Dreyer?s/Edy?s ice cream, Hershey?s chocolate and Lay?s potato chips are trying to solve this age-old dieter?s dilemma by rolling out mid-calorie goodies that have more fat and calories than the snacks of earlier diet crazes but less than the original versions. They?re following the lead of soda companies such as Pepsi and Dr Pepper that introduced mid-calorie drinks last year.
It?s hard to isolate sales of mid-calorie snacks because they also usually have reduced fat, or other healthy attributes such as reduced sodium. But sales of all foods and drinks in which the amount of things such as fat, sugar, salt, carbohydrates have been actively reduced during production have risen 16 percent to $51.72 billion since 2006, according to research firm Euromonitor International.
The mid-calorie trend is hitting at a time when companies that make sugary and salty treats are being blamed for the country?s expanding waistlines. The problem is that the same things that make snacks taste good ? sugar, salt, calories ? also make them fattening. And many Americans don?t want to sacrifice taste at snack time. Shaving a few calories enables companies to market their cakes, cookies and chips as healthier without the stigma of bad taste that goes along with some low-fat products.
The mid-calorie trend is a toned-down version of the "light" craze that started in the 1990s. Back then, "low fat" or "no fat" was all the rage. But the products often fizzled.
For instance, McDonald?s rolled out the McLean Deluxe, a low-fat burger, in 1991. But the burger, which was made with seaweed, had dismal sales. It disappeared from restaurants within five years.
Similarly, Lay?s in 1998 introduced Wow fat-free potato chips that use fat substitute Olestra. But the ick factor trumped healthiness when the Food and Drug Administration said the chips had to come with a warning that Olestra may cause abdominal cramping, loose stools, and that it inhibits the absorption of some vitamins and other nutrients.
The FDA dropped the requirement for the label in 2004 after studying the matter. The chips were renamed "Light," but sales have not recovered.
The new era of diet food started in the past decade. In 2007, companies began offering 100-calorie packs of popular snacks like Oreos cookies and Twinkies cakes. That?s when brands started putting their focus on reducing calories ? without any flavor change.

Reducing a nominal number of calories in your diet each day ? even from that morning coffee run or afternoon visit to the vending machine for chips ? is an effective way to battle obesity, says David Levitsky, professor of nutritional sciences at Cornell University.
But in order for that to work you have to eat the snacks in moderation. "If consumption of ice cream and potato chips does not increase and people eat somewhat better versions, the outcome will be good," Brownell says.
First, companies have to convince dieters that their mid-calorie snacks are not only healthy, but tasty, too.
With that in mind, Hershey?s in June introduced Simple Pleasures, chocolate with 30 percent less fat. A serving size of six pieces equals 180 calories and 8 grams of fat ? that?s 30 calories and 5 grams of fat less than the original Hershey?s chocolate bar. The company is hoping the deficit is enough to lure chocolate lovers who want to eat healthier.
Similarly, Lay?s in July rolled out two new flavors of its Kettle Cooked potato chips with 40 percent less fat. The brand, which fries chips in small batches so as to use less oil than the continuous frying process for regular chips, introduced "Applewood Smoked BBQ" and "Sun-Dried Tomato and Parmesan."
The company says it was able to lower the calories and fat without sacrificing taste. Regular Kettle Cooked chips have 160 calories and 9 grams of fat, while the reduced-fat versions have 130 calories and 6 grams of fat.

President Obama and Republican nominee Mitt Romney seem to be living in alternate economic realities. In Obama?s world, his policies led the economy out of the worst recession since the Great Depression and lay out a balanced approach to deficit reduction. In Romney?s world, Obama?s policies have been a drag on the economy and will eventually make the country as debt-laden as Greece.
Nobody expects a presidential candidate to put forward an economic plan that isn?t flavored with a little ideology. But whoever wins may have a problem: Each has cherry-picked statistics to suggest his own economic plan will result in economic growth, but if he?s wrong, he?ll have both destroyed his credibility and failed to solve the problem voters care most about.???
Romney has argued that his plan of deregulation and lower taxes would unleash a wave of growth; Obama has backed away from the word ?stimulus? and offered a higher tax rate on the wealthy. Each candidate has deployed a stable of experts and academics to back up his claims, but neither side is telling the full story. ?
The partisan back-and-forth is enough to make your head spin. Take this recent debate between an Obama and a Romney adviser, hosted by the National Association for Business Economics.?
?Everyone knows that the problem is spending,? said Romney?s adviser, American Enterprise Institute senior fellow Kevin Hassett. ?Spending is not out of control in this country,? maintained Obama adviser and Harvard Professor Jeffrey Liebman. Each man accused the other of putting forward fudged numbers and referring to partisan studies.?
In economics, assumptions help drive thinking?and in a partisan election, assumptions can become etched in stone. ?Remember, economics is not a physical science,? said Jared Bernstein, senior fellow at the Center on Budget and Policy Priorities and former economic adviser to Vice President Joe Biden.
Supply-side theory, the Republican contention that cutting taxes leads to growth, is based more on ?wishful thinking? than experience, Bernstein said. On the Democratic side, he said, the idea that entitlement spending doesn?t need to be checked is just as fantastical.
The campaign trail rhetoric doesn?t mean there?s no expert consensus. A February survey of leading economists from the University of Chicago Booth School of Business found overwhelming agreement?that the 2009 stimulus helped stave off job losses. In other Chicago Booth surveys, no respondents said lowering income taxes would lead to so much income growth that, five years later, tax revenue would have increased, and respondents disagreed with the idea that raising taxes on the wealthiest Americans would be enough to substantially reduce budget shortfalls.
?The best plan would deal with short-run issues?but do so in the context of stabilizing the public debt-to-GDP ratio,? said William Longbrake, executive-in-residence at the University of Maryland Robert H. Smith School of Business. The ideal program would have a ratio of about $2 of spending cuts for every $1 of tax increases, Longbrake said, along with a short-term spending plan to boost the economy right away.?
Obama?s 2011 jobs proposal, the American Jobs Act, included some ?sensible? ideas for creating jobs in the short term, said Gary Burtless, senior fellow in Economic Studies at the Brookings Institution. But it wasn?t about to restore full employment, and it was dead on arrival in Congress. Obama rarely utters the word ?stimulus? on the campaign trail, though many experts argue that more stimulus wouldn?t hurt.
Romney, meanwhile, has slammed the $787 billion 2009 stimulus as careless and accused Obama of presiding over an explosion of regulation and spending that has stifled growth. The Romney camp argues that ?uncertainty??caused by deficit spending?has been a drag on the economy, but that claim is hard to quantify. So is the GOP claim that lower income taxes lead to economic growth.
?We really don?t have any evidence that [personal income-tax rates have] any effect on growth,? University of California (Berkeley) Professor Alan Auerbach recently told Bloomberg Businessweek. ?A lot of the research showing otherwise is based on theoretical calculations.??Economists agree that lowering corporate taxes would help businesses, and both candidates have put forward a plan to do so.
Team Obama likes to talk about how low taxes during the George W. Bush years coincided with economic stagnation, while higher Clinton-era tax rates coincided with economic growth and a federal surplus. But Obama isn't advocating for the Bush tax cuts to expire, focusing instead on raising taxes on the highest earners. The logic is that the revenue increase would go toward reducing the deficit, but critics point out that the revenue increase would be just a drop in the bucket.
Romney has conceded that reducing government spending too fast would be bad for the economy in the short term, and Obama has acknowledged that the growing deficit is a long-term problem. But both candidates have put forward an economic plan that?s as much about values as it is about economics. Obama has characterized higher taxes on the wealthy and protecting discretionary spending as matters of fairness. Romney has called deficit spending ?immoral.?
Former President Clinton, at the recent Democratic National Convention, said that creating budget surpluses was a matter of just one thing: ?arithmetic.? This election, supposed to be all about the economy, has proved that economic arithmetic can be more flexible than you might suppose. It may be an election about the economy, but it?s not an election about economics.?

You may not realize it but low self-esteem will ultimately take its toll on you. If you have low self-esteem, you are limited to a more smooth realization. If you are not quite assured, then let the later descriptions brighten you.
Generally, you perceive of yourself-as someone who is quiet and shy for most of the time, occasionally to the point that you think of yourself-as the lowest of the low. You do not believe in your faculty or on the things that you can do, and you just stay quiet even though you render certain, in your heart of hearts, that you can do it.
If these things occur to you then something in you questions your capacity to construct certain tasks because you bear it like you lack the self-confidence to push it towards completion.
Low self-esteem indeed controls you and holds you down. It prevents you from doing things that you can indeed perform victoriously. It also prevents you from achieving something greater. Low self-respect must be abolished from everyone?s mentality so that everybody can perform to his or her best abilities.
When you were born, you were not born with limited self-esteem. It is not inborn. It gets developed consequently through hardships and trials. Some events may govern to your losing your self-confidence.
These said events are generally traumatic and it sticks within your head, which is the key why you tend to lose your self-worth little by little, occasionally, even as an entirety.?Instances like getting humiliated in public, or making a bad decision, in some point of your evolution, that cost you something that was worthy or significant to you.
Another statistical situation would be that, something happened to you in your youth and it made you lose your self-esteem. Basically, everyone does not have low self-esteem at birth, nor a high one at that point, but everyone has a self-esteem that is of median rate, and it is only your adventures that determine whether you will be having a high one or a low one.
Once your self-honor is lost, does that terminate that you are never going to have high self-esteem over again? The answer is no. You can indeed regain it. If you have a low self-esteem since previous bad fortunes, one thing to defeat this problem is to face that certain bad event and turn it into a beneficial one.?You must make that bad thing into something that is more effective.
In that way, every time you experience that experience, or any another event that is closely connected to the foregoing, what you will recall from it is the good thing and not the bad sensation you got.
You must always keep in mind that you should make safe your self-respect. It is eventful for the human race around you, but more eventful for your own prosperity. You must also recall to teach your children the values and abilities in order for them to be capable to conserve their self-esteem.
You should imbue in them self-confidence to front each day with their heads up towering, because a low self-esteem or neglect of confidence will determine what kind of a generation they will be.
Low self-esteem will hold people down from indicating their real influence. If you have a low self-esteem, you should try, as much as possible, to win over it in the quickest term. You may never comprehend what you can do if only you have the self-confidence to achieve it.

This weekend, my friends and I hosted a baby shower for our friend Allison and her sweet baby boy on the way. We had it at our house and it was fun to have everyone here. And to have an excuse to get my house as clean as possible!
When Allison told us that she was using navy, green, madras, and alligators in the baby?s nursery, we decided to use that as inspiration for her baby shower.
We decided on a ?See You Later, My Little Alligator? theme.
We called on the talented girls at Sweet Birdie?s Nest to help us make the theme come to life. They created party circles, cupcake toppers, a banner, a welcome sign, and a great set of prints for us to frame for Allison. I love these colors and think they?re just so fun and happy!
This fun little set of prints (excuse the horrible glare) was framed on the welcome table. We also had fun little note cards with a number on them for months 1-12. The guests were asked to write advice and encouragement to Allison for each of those months.
Also on the welcome table, we had these delicious and oh-so-cute cookie favors from Holly at Doughmestic Housewife. Holly?s cookies are so soft and yummy and I?ll say it again?. they are little works of art! (Holly ships and takes custom orders!)

My friend Caroline brought delicious chicken salad sandwiches on croissants.
My friend Tina made pimento cheese sandwiches. Goodness, this is making me hungry!
Allison said she has been craving fruit, so I made my friend Emily?s pineapple pretzel salad recipe that I?ve posted before. Yummy!
My friend Allyson put together a pretty vegetable platter.
And of course no shower is complete without fluffy cupcakes from Publix and sweet cupcake toppers.

I made these baked brie bites. I found the recipe on Pizzazzerie, and I will definitely be making these again.
My friend Caroline brought this wonderful spinach dip, and I think it looks so pretty!

Barnes & Noble this morning announced Nook Video, which will stream, erm, video from HBO, Sony, STARZ, Viacom, Warner Bros. and Disney to the Android-based e-reader. That brings it a little more in tune with the likes of Amazon's Kindle Fire, which long has taken advantage of streaming video
Also, you'll be able to link your purchases of physical DVD and Blue-ray discs to your Nook via UltraViolet, making the deal that much sweeter.
Customers in the U.S. will get Nook Video this fall; those in the UK have to wait until the holiday season.

The Be OPEN Sound Portal was created for this year?s London Design Festival, and is situated in the middle of Trafalgar Square, one of London?s busiest public spaces. The pavilion seeks to provide an aural sanctuary from all the hustle and bustle, and to show that designers should not just focus on the visual. Designed by Arup and commissioned by Sound and Music (SAM), the Sound Portal featured work from five sound artists over the course of the design festival, with pieces ranging from glacier sounds to electronica. The pavilion is part of a larger project by the think tank BE OPEN, which set out to create installations focusing on each of the five senses. After the design festival, the pavilion will be installed at Chelsea College of Art and Design, and will feature sound works by students.
